TERMS OF SERVICE

Last updated 24 August 2026

1. Introduction, scope, and acceptance

These Terms of Service (“Terms”) govern your access to and use of System Design Lab (the “Platform”), including courses, lessons, downloadable resources, and any communications we send you.

The Platform is operated by System Design Lab, a sole proprietorship operated by Dave Connis, based in Georgia, USA. Contact: dave@systemdesignlab.co.

By creating an account, purchasing a membership, or otherwise using the Platform, you agree to be legally bound by these Terms. If you don't agree, don't use the Platform.

2. Memberships, billing, and auto-renewal

2.1 Plan types

We offer a free tier (limited content) and paid memberships billed monthly or annually (“Memberships”). Current pricing is shown on the pricing page and at checkout.

2.2 Payment and auto-renewal

Membership fees are charged upfront at the start of each billing cycle through our payment processor, Stripe. By providing payment details, you authorize us and Stripe to charge the applicable fee at purchase and at each renewal.

Memberships automatically renew at the end of each term (monthly or annual) at the then-current price unless you cancel before the renewal date. We'll send a renewal reminder before each annual renewal to the email on your account.

2.3 Cancellation

You may cancel anytime from your account settings or by emailing dave@systemdesignlab.co. Cancellation stops future charges; you keep access until the end of your current paid period. Cancelling does not entitle you to a refund for the current period.

2.4 Refunds and EU withdrawal rights

Except as required by law, all payments are non-refundable.

EU residents — 14-day right of withdrawal. If you reside in the European Union, you have a legal right to withdraw from your initial Membership purchase within 14 days of the purchase date, unless you have already accessed the digital content.

By starting to watch lessons or otherwise accessing paid content on the Platform before the 14-day period ends, you expressly consent to immediate performance and acknowledge that you waive the 14-day right of withdrawal. This right applies only to the first purchase of a Membership; renewals are a continuation of the same contract and are not treated as new purchases.

2.5 Receipts

An emailed receipt is sent automatically after each successful payment. If you need a more detailed invoice for tax purposes, contact dave@systemdesignlab.co.

3. Accounts, access, and use

3.1 Eligibility

You must be at least 16 years old to create an account. By creating an account, you confirm that you meet this age requirement and that the information you provide (name, email, and any other account details) is accurate and kept up to date.

3.2 Account security

You're responsible for keeping your login credentials confidential and for all activity that happens under your account. Contact dave@systemdesignlab.co immediately if you suspect unauthorized access.

3.3 License to use the Platform

A Membership grants you a personal, non-transferable license to access the Platform content during your subscription term.

You may not: share your account credentials, resell access, screen-record or redistribute course videos or written materials, scrape the Platform, or attempt to circumvent access controls or paywalls.

3.4 Suspension and termination

We may suspend or terminate accounts that violate these Terms. Where possible, we'll contact you first to give you a chance to remedy the violation.

You may terminate your account at any time by cancelling your Membership (section 2.3) and requesting account deletion from your account settings or by emailing dave@systemdesignlab.co. Sections 5 (your content), 7 (intellectual property), 8 (disclaimers and limitation of liability), and 9 (indemnification) survive any termination of your account.

4. Marketing communications

By creating an account, you agree to receive transactional emails (account, billing, and platform updates). These are not optional while your account is active.

You may separately opt in to receive product updates, new-lesson announcements, and occasional educational emails. Each of these has its own unsubscribe link and you can opt out at any time. For EU residents, marketing emails are sent in accordance with GDPR and the ePrivacy Directive.

5. Your content (notes and feedback)

Notes and feedback you create on the Platform remain yours. You grant System Design Lab a limited license to store, display, and process this content as needed to provide the service, including following up with you directly about feedback you submit.

You can export or delete your notes at any time from your account. When you delete your account, your notes are permanently removed within 30 days.

6. Consumer rights (EU residents)

Nothing in these Terms limits your statutory rights under EU consumer law, including:

  • Clear information about pricing and renewal terms.
  • The right to cancel auto-renewal at any time before renewal.
  • A 14-day withdrawal right for the initial purchase, unless waived as described in section 2.4.
  • The right to a refund for substantially defective digital content.

7. Intellectual property

All Platform content — including course videos, lesson scripts, written materials, graphics, code, designs, logos, trademarks, and the “System Design Lab” name — remains the exclusive property of System Design Lab or its licensors and is protected by US and international copyright and trademark law.

We grant you a limited, personal, non-exclusive, non-transferable license to access the content for your own learning during your Membership. Any other use requires written permission.

8. Disclaimers and limitation of liability

The Platform is provided “as is” without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not guarantee uninterrupted availability, error-free playback, or that any specific outcome will result from taking the courses.

To the maximum extent permitted by law, System Design Lab is not liable for indirect, incidental, consequential, or special damages. Our total aggregate liability for any claim arising out of or related to these Terms or the Platform shall not exceed the amount you paid for your most recent subscription period.

Nothing in this section limits liability that cannot be excluded under the laws of your country of residence (e.g. consumer-law rights for EU residents).

9. Indemnification

You agree to defend, indemnify, and hold harmless System Design Lab and Dave Connis from any claims, damages, liabilities, and reasonable expenses (including attorneys' fees) arising from your violation of these Terms, your misuse of the Platform, or content you submit that infringes a third party's rights. This obligation survives termination of your account.

10. Taxes

Prices shown on the Platform are in US dollars and do not include taxes unless otherwise stated. Where required by law, US state sales tax is calculated and added at checkout via Stripe Tax.

For customers outside the US: System Design Lab is not currently registered for VAT in the European Union or other foreign jurisdictions. Any import duties, VAT, or other taxes that may apply in your jurisdiction are your responsibility. We will update this section if our tax registration status changes.

11. Third-party services and sub-processors

We use the following third-party services to operate the Platform. Each is bound by its own privacy and security commitments:

  • Stripe — payments and subscription billing
  • Supabase — account database and authentication
  • Bunny — video hosting and playback
  • Resend — transactional and marketing email delivery
  • Beehiiv — product announcement and new-lesson email delivery
  • Vercel — application hosting

12. Governing law and jurisdiction

For US residents and customers outside the EU: these Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles. You and System Design Lab agree to the exclusive jurisdiction of the state and federal courts located in Georgia for any dispute arising out of or related to these Terms or the Platform.

For EU residents: these Terms are governed by the laws of your country of residence, and disputes may be brought before the competent courts of that country, in accordance with EU consumer law.

13. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy and Refund Policy, make up the entire agreement between you and System Design Lab regarding the Platform, and supersede any prior agreements on the same subject.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions stay in full force and effect.

No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.

Force majeure. We're not liable for delays or failures caused by circumstances beyond our reasonable control, including outages at our third-party service providers.

Notices. We may send notices to the email address on your account. Notices to us should be sent to dave@systemdesignlab.co.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email to the address on your account at least 14 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
